The training of workers on occupational safety and health through the "e-learning" methodology is governed by the State-Region Agreements of 21 December 2011 and 7 July 2016. The Agreements define the criteria and the conditions that allow the use of this methodology and it is indicated for which courses it is allowed to use.

Some types of courses on health and safety in the workplace require the employer to request a collaboration with the joint body of reference by type of contract and sector of activities.

All courses are delivered in eLearning mode from the LMS DynDevice platform, compliant with the requirements of Annex II of the Regions State Agreement of 7 July 2016 and with continuous monitoring of the training process.

What is occupational safety?

Occupational safety (abbreviated as SSL) is the condition for everyone who works, to carry out their work safely, without exposing them to the risk of accidents or occupational diseases. Occupational safety concerns the set of preventive and protective measures to be adopted to better manage the health, safety and well-being of workers; in order to avoid or minimize accidents and occupational diseases caused by the exposure of workers to the risks associated with working activities.

What does "doing security" mean in the company?

It means contributing to the balanced training of the worker, aware of his individual responsibility in the relationship with himself, with others and with the environment.

What is health?

For the World Health Organization health is a "state of complete physical, mental and social well-being and not the mere absence of a disease or illness (WHO-1948)". This definition was taken up by art . 2, paragraph 1, lett. o) of Legislative Decree no. 81/08, which defines health as a "state of physical, mental and social well-being, not only consisting in an absence of illness or infirmity."

From what law is workplace safety regulated?

Health and safety at work are regulated by the Consolidated Law on Safety at Work (Legislative Decree No. 81 dated 9 April 2008, which came into force on 15 May 2008), and by the relative corrective provisions, or by the "D . Leg. 106/2009 ". This decree, which has had many historical precedents (dating back to 1955 and 1956) and others more recent (such as Legislative Decree 626/1994), transposes in Italy the European Directives (3 August 2007, n. 123) in the matter of protection of the safety and health of workers, coordinating them in a single regulatory text, which provides for specific sanctions against the defaulters.

What are the general measures indicated in the Consolidated Law 81/08 for the health and safety of all workers?

  • assessment of all health and safety risks;
  • elimination of risks or if it is not possible to reduce them in relation to technical knowledge;
  • replacing risks at source;
  • limited use of chemical, physical and biological agents in the workplace;
  • health control of workers;
  • adequate information and training for workers;
  • adequate information and training for managers and supervisors;
  • adequate information and training for workers' safety representatives;
  • participation and consultation of workers;
  • participation and consultation of safety representatives;
  • programming of the measures deemed appropriate to ensure the improvement of the level of security over time, also through the adoption of codes of conduct and good practices.

What does the Civil Code of safety at work say?

Article. 2087 of the Civil Code obliges the employer to "adopt in the exercise of the company the measures which, according to the particularities of work, experience and technique, are necessary to protect the physical integrity and the moral personality of the lenders of work."

What is the peculiarity of the job?

is the fact that safety covers all the risks and dangers associated with a specific activity that may include the inhalation of chemical substances, the need to use special machinery, a certain clothing and more. It goes without saying that the job of a teacher is different from that of a construction worker, just to give an example, and the article of the Civil Code highlights it.

What is the work experience?

Those who are experts in that work, have been doing it for years, are more aware of possible situations of danger, perhaps even based on events that have already occurred or for ad hoc training over the years.

What is work technique?

We mean scientific and technological progress to ensure greater safety for the worker. To give an example: use a helmet model that is perhaps more powerful, or uniforms that are even more suitable than previous models to protect against fires, etc.

What is the prevention and protection service?

The prevention and protection service (SSP) - provided for by the Consolidated Law - is made up of people, systems and means, external or internal, whose purpose is to prevent and protect against risks.

What is the culture of prevention?

The culture of prevention is an attitude that is created, first of all, with training and information. Workers are not only protected subjects but also active actors: they must be aware of the conditions of their work environment and of their specific job, the use of safety devices and participants in risk assessment and prevention activities.

What is risk assessment?

Risk assessment is an activity that concerns all the risks for the safety and health of workers, including those concerning groups of workers exposed to particular risks ”, including those related to work-related stress, to female workers pregnant, as well as those related to gender differences, age, origin from other countries.

What is the risk assessment document?

It is the document, drawn up at the end of the risk assessment, it must have a certain date and contain:

  • a report on the assessment of all risks to safety and health during work, in which the criteria adopted for the evaluation are specified;
  • indication of the prevention and protection measures implemented and the individual protection devices adopted, following the evaluation referred to in Article 17, paragraph 1, letter a);
  • the program of measures deemed appropriate to ensure the improvement of security levels over time;
  • the identification of the procedures for the implementation of the measures to be implemented, as well as the roles of the company organization that must provide them, to which only subjects in possession of adequate skills and powers must be assigned;
  • the indication of the name of the person in charge of the prevention and protection service, of the worker safety representative or of the territorial representative and of the competent doctor who participated in the risk assessment;
  • the identification of the tasks that may expose workers to specific risks that require recognized professional skills, specific experience, adequate training and training;
  • the content of the document must also respect other indications foreseen by the specific norms on the evaluation of specific risks (eg risks from physical agents, chemical substances, biological, etc.).

What is health surveillance?

Health surveillance is a vigilance aimed at assessing the suitability of the worker for the specific tasks for which he is intended. The assessments can be estimates, periodic or linked to particular events (change of job, or periods of illness exceeding 60 consecutive days). At the end of the checks and based on their outcome, it is up to the competent doctor to decide on the suitability itself. In case of judgment of unsuitability for the job, the employer is required to assign the worker, where possible, to another job compatible with his state of health.

Who is the employer?

The employer is the person who holds the employment relationship with the worker or, in any case, the person who, according to the type and structure of the organization in which the worker is working, is responsible for organization itself or of the productive unit as it exercises decision-making and spending powers. For the purpose of occupational safety, employers are defined as anyone who is at the top of work organization and production activity, regardless of any form of formal investiture.

Who is the worker?

The worker is the person who, regardless of the type of contract, carries out a job in the organization of a public or private employer, with or without pay, even for the sole purpose of learning a trade, a art or profession, excluding domestic and family service workers. The employee thus defined is equated: the member working as a cooperative or a company, even de facto, who carries out his activity on behalf of the companies and the entity itself; and the associated participant referred to in Article 2549.

Who is the Head of the Prevention and Protection Service (RSPP)?

The person responsible for the prevention and protection from professional risks service is the person responsible for implementing the initiatives promoted by the Prevention and Protection Service and described in the risk assessment document. Typically, these activities are:

  • identify risk factors, carry out risk assessment and identify measures for safety and health in the workplace, in compliance with current legislation based on the specific knowledge of the company organization;
  • elaborate, for what of competence, the preventive and protective measures and the control systems of such measures;
  • develop security procedures for various business activities;
  • propose information and training programs for workers;
  • participate in consultations on the protection of health and safety at work, as well as the periodic meeting;
  • provide the workers with the necessary information.

Who is the Manager of the prevention and protection service (RSPP)?

Who is the security manager?

The safety manager is the person who, by virtue of the professional skills and hierarchical and functional powers appropriate to the nature of the task assigned to him, implements the employer's directives by organizing the work activity and supervising it ( Article 2 of Legislative Decree No. 81/2008). The safety manager supports the employer in the tasks of implementing the management system for safety and health in the workplace, making its directives operational, organizing work activities and carrying out adequate checks.

Who is the teacher for workplace safety

The teacher for workplace safety is a figure able to plan, manage and carry out safety training courses for any type of company and for all security figures: employer, manager, person in charge, RLS, ASPP, worker. The criteria for the qualification of the teacher-trainer in the field of Occupational Health and Safety are defined in the Decree of the Ministry of Labor and Social Policies and of the Ministry of Health of 6 March 2013 titled "Qualification criteria of the figure of the health trainer and safety at work ". This is a prerequisite and a series of specific requirements. The trainer is therefore qualified as being able to demonstrate possession of both the prerequisite and one of the 6 criteria indicated in the decree.

Who is the person in charge?

The person in charge is the person who supervises the work activity and guarantees the implementation of the directives received, controlling the correct execution by the workers and exercising a functional power of initiative, with or without the investor's formal investiture. Practically, the person in charge is the figure that supports the employer in the control activities even when the latter cannot guarantee his constant presence during the work phases. The charge of the supervisor must be formalized by the employer, also at the contractual level, specifying the nature of the assignment and the scope of the hierarchical and functional powers.

Who is the Workers' Safety Representative (RLS)?

The RLS (Worker Safety Representative) is the person elected or appointed to represent workers on aspects of health and safety at work (articles 37, 47, 50 of Legislative Decree 81/2008). The RLS must have both the necessary training to manage relations with the workers for issues concerning health and safety at work, and access to information and activities related to the management of safety at work.

Who are the employees of the Prevention and Protection Service?

The Prevention and Protection Service Attendant (ASPP) is the one who helps the Head of the Prevention and Protection Service (RSPP) to carry out the activities that concern the safety of the company. Depending on the needs and the company structure, one or more may be appointed by the Employer. Even if not expressly provided for by law, given that it is the employer who organizes the prevention and protection service primarily within the company or production unit, or appoints external persons or services, the appointment of the ASPP (or ASPP) ) is part of the employer's obligations, after consulting the Workers' Safety Representative.
