1 – INTRODUCTION

Mega Italia Media S.p.A. is aware of the importance of protecting the personal data of our users. All data is processed in a lawful, fair, and transparent manner towards the data subject, in compliance with the general principles provided by EU Reg. no. 2016/679 and the current national legislation on the protection of personal data.

This Privacy Policy describes the management methods for personal data processed through the Mega Italia Media website (www.megaitaliamedia.com) or any other contact channel, in order to inform the data subject about the methods of processing personal data pursuant to Articles 13 and 14 of EU Reg. no. 2016/679 on the protection of personal data (GDPR). It is addressed to visitors of the website www.megaitaliamedia.com and to Customers who use the services provided by the Data Controller.

3 – TYPES OF DATA COLLECTED

The website offers informative and, at times, interactive content. During navigation of the Site and the Controller’s channels, information about the visitor may be acquired in the following ways:

Navigation data

The computer systems and software procedures used to operate this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the user’s operating system and computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning and is deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site.

Data Provided Voluntarily by the User

The forms on the site collect identifying, contact, and accounting data voluntarily provided by the user. Failure to provide such data may result in the impossibility of obtaining what is requested. The Controller will use this information only to respond to the user’s requests.

3.1 – PURPOSES AND LEGAL BASIS OF THE PROCESSING

The processing of personal data of Data Subjects, collected through forms, chatbots, e-mail, telephone, mail, and/or any other contact channel, is carried out for the following purposes:

a) to ensure access to the Site, navigation, and use of online services:

  1. to respond to requests for information regarding Mega Italia Media products/services, assistance requests related to the methods of using the site, and for the activation of courses in Demo mode;
  2. to provide quotes for products/services offered by Mega Italia Media;
  3. for the sale of products/services offered and for the activation of online courses on the eLearning platform;
  4. to respond to assistance requests related to the use of the products/services offered;
  5. for administrative and accounting purposes to comply with contractual and legislative obligations related to the requested services;

b) subject to the User’s consent:

  1. for information and commercial promotion purposes of our products and services, through newsletter subscription or to respond to requests for a printed catalog;
  2. to allow the posting of comments and opinions on the website on the product/service pages offered.
  3. to collect data through statistical and profiling cookies, in order to perform remarketing and behavioral targeting activities, as well as for statistical and site performance analysis.

c) the pursuit of legitimate interests of the Data Controller, such as:

  1. for direct marketing activities addressed to its customers, who are guaranteed the right to object, in consideration of the established relationship and the protection of fundamental rights and freedoms;
  2. for the ascertainment of responsibility in case of hypothetical computer crimes against the site.

The legal basis for the processing is:

  • for the purposes referred to in point a), the fulfillment of the data subject’s requests, the performance of pre-contractual and contractual measures, and legal obligations;
  • for the purpose referred to in point b), the consent freely expressed by the data subject;
  • for the purpose referred to in point c), the legitimate interest of the Data Controller.

3.2 – PROCESSING METHODS AND RETENTION PERIODS

The personal data covered by this information notice are processed using both paper and electronic methods, with the adoption of suitable measures to ensure their protection, by collaborators authorized for processing. Personal data may be shared, in compliance with applicable rules and only for the purposes and under the conditions indicated in this notice, with public entities for legal obligations, or with data processors or co-controllers with whom specific agreements are signed.

The Data Controller guarantees technical and organizational measures to provide an adequate level of security and confidentiality for the processing of personal data. These measures take into account the state of the art of technology, implementation costs, the nature of the data, and the risks associated with their processing.

The data are stored, without prejudice to any retention periods provided for by law:

  • personal data processed for legal and contractual obligations will be stored for 10 years;
  • personal data processed to respond to requests from data subjects will be stored for a period not exceeding the time necessary to respond to the request;
  • personal data processed for direct marketing activities will be stored for a maximum period of 24 months from the date of the last contact;
  • processing carried out with the data subject’s consent will continue until the consent is revoked;
  • in the event of litigation with a data subject or a specific request from the competent Authorities, personal data may be stored for as long as necessary to protect the Data Controller’s interests or comply with the Authority’s request.

4 – CATEGORIES OF SUBJECTS TO WHOM DATA MAY BE COMMUNICATED

The collected and processed data may be communicated, exclusively for the purposes specified above, to entities belonging to the following categories:

  • hosting providers, consulting firms, communication agencies, third-party technical services;
  • individuals, companies, or professional firms providing assistance and consultancy to the Data Controller in accounting, administrative, legal, tax, and financial matters;
  • subjects to whom the right to access data is recognized by law or by orders from competent authorities.

5 – USER RIGHTS REGARDING THEIR PERSONAL DATA

The data subject, i.e., the natural person to whom the personal data refers, has the right to request from the Data Controller access to their personal data, rectification or erasure of the same, as well as to request the restriction of or object to their processing. The data subject also has the right to data portability. To exercise these rights, you can refer to the contacts indicated in this notice.

All requests received will be processed and answered according to the applicable rules, also with reference to the actual existence of the conditions for their acceptance. If these conditions are not met, the Data Controller may not follow up on the requests. The Data Controller makes every effort to respond to legitimate and grounded requests within one month of receipt. Depending on the complexity and number of requests, as well as what is indicated above, this period may be extended by two months.

Upon conclusion of the management of the request and against it, the data subject has the possibility to lodge a complaint with the supervisory authority www.garanteprivacy.it and to seek a judicial remedy.
