Who is the DLSPP (Employer who assumes the role of Head of the Prevention and Protection Service)?

The employer, according to the definition of the article 2 of the Legislative Decree 81/08, is “the subject of the employment relationship with the worker or, however, the person who, according to the type and structure of the organization in which the worker carries out his / her activity, has the responsibility of the organization itself or of the production unit as it exercises decision-making and spending powers ".

The Law allows the Employer to personally take over the tasks of RSPP (which is then called Employer RSPP or, more correctly, Giver of SPP Work, abbreviated as DLSPP), and regulate in art. 34 Legislative Decree 81/08 - relating to the direct performance by the employer of the tasks of prevention and protection from risks - the cases in which it can do so:

  • Employers of craft companies up to 30 employees;
  • Employers of industrial companies up to 30 employees (excluding the activities referred to in Article 1 of Legislative Decree 334/99 - SEVESO Regulations: companies subject to the obligation to report or notify, thermoelectric plants, nuclear plants or laboratories, mining and other mining activities, for the manufacture and separate storage of explosives, dust, ammunition, public and / or private shelters);
  • Employers of agricultural and zootechnical companies up to 10 employees;
  • Employers of fishing companies up to 20 employees;
  • Employers from other companies up to 200 employees.

The employer who intends to play the role of RSPP must have a high school diploma and a certificate of attendance for the specific training course. However, they can also perform the RSPP function, including Employers who do not have a high school diploma but have already performed the same function for at least six months.

What training courses must the RSPP Employer take?

The D.Lgs. 81/08 provides a specific training course for RSPP Employers; in the Agreement of the State-Regions Conference of 12/21/2011 the contents and durations of these DLSPP training courses were defined, different according to the risk classification of the company:

  • the low risk company employer must take 16 hours of course: for employers of companies in the wholesale and retail sectors; craft activities (bodywork, vehicle repairs, laundries, hairdressers, bakers, confectioners, etc.); hotels, restaurants; Real estate, information technology; recreational, cultural and sporting associations; domestic services - territorial bodies.
  • the medium-risk company employer must do 32 hours of training: for employers of companies in the sectors of agriculture, fishing, transport, warehousing, non-residential social assistance, public administration, education.
  • the high-risk company employer must take 48 hours of course: for employers of companies in the mineral extraction sectors; buildings; textile clothing food industries; metal production and processing; mechanical appliances; manufacture of machines, electrical and electronic equipment; vehicles; furniture; production and distribution of electricity, gas and water; waste disposal; refineries; chemical industry; health; residential social assistance.

The contents of the RSPP Employer training courses must include, as a minimum, 4 modules:

  • Module 1 Regulatory: legal
  • Module 2 Management: security management and organization
  • Module 3 Technical: Identification and assessment of risks
  • Module 4 Relational: training and consultation of workers

The eLearning training for RSPP Employers is allowed for module 1 (Normative) and for module 2 (Management). The modules 3 (Technical) and 4 (Relational) must necessarily be carried out in the presence.

What training courses must the RSPP Employer take?

The employers who directly perform the tasks of the Prevention and Protection from Risks (DLSPP) and who have already taken the course for employer RSPP work must carry out - in accordance with art. 34 of Legislative Decree 81/2008 - a five-year update adapted to the three different levels of corporate risk:

  • update for RSPP employers of low-risk companies lasting 6 hours
  • update for RSPP employers of medium-risk companies for 10 hours
  • update for RSPP employers of high-risk companies lasting 14 hours

The update can be done in eLearning mode for all three levels of corporate risk and must be complied with within the five years following the acquisition of the degree and every five years thereafter. In case of failure to update, the Employer RSPP function will be frozen until the update has been done.

The State-Regions Agreement of 7 July 2016 also provides that "the update for workers, supervisors, managers, employers who intend to perform the tasks of the service of prevention and protection of which to the agreements of December 21, 2011 and that for the worker safety representative pursuant to article 37, paragraph 11, of Legislative Decree No. 81/2008 can be complied with by participation in conferences or seminars to the extent not exceeding 50% of the total number of hours scheduled ".
